1. Acceptance of Terms

By accessing or using the FYNCA platform at www.fynca.com.sg ("Platform"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Platform. These terms are governed by the laws of the Republic of Singapore.

2. About FYNCA

FYNCA is a loan matching intermediary that connects Singapore-registered businesses with a panel of licensed lenders. We are not a bank, financial institution, or licensed moneylender. We do not lend money directly and do not guarantee the approval of any loan application. All lending decisions are made solely by our lending partners.

3. Eligibility

To use our Platform, you must:

• Be at least 18 years of age
• Be a director, partner, or authorised representative of a Singapore-registered business
• Have the authority to submit financial information on behalf of the business
• Not be an undischarged bankrupt

4. Our Services

FYNCA provides the following services at no charge to borrowers:

• Assessment of your loan eligibility based on information you provide
• Matching your application with suitable lending partners from our panel
• Facilitating communication between you and lending partners
• Providing an application tracking portal

FYNCA earns fees from lending partners upon successful loan disbursement. These fees are borne by the lenders and do not affect the loan terms offered to you.

5. Accuracy of Information

You agree to provide accurate, complete, and truthful information when submitting a loan enquiry or uploading documents. Providing false or misleading information may constitute a criminal offence under Singapore law, including under the Penal Code and the Moneylenders Act. FYNCA reserves the right to reject or withdraw any application where false information is detected.

6. No Guarantee of Loan Approval

Submitting an enquiry on our Platform does not constitute a loan application to any specific lender, nor does it guarantee loan approval or the terms of any loan. All credit decisions are at the sole discretion of the individual lending partners. FYNCA makes no representations or warranties regarding the likelihood of approval or the terms you may receive.

7. User Responsibilities

You agree that you will not:

• Use the Platform for any unlawful purpose
• Submit fraudulent, forged, or altered documents
• Attempt to gain unauthorised access to any part of our Platform
• Interfere with the operation of the Platform or its infrastructure
• Use the Platform on behalf of a third party without proper authorisation

8. Intellectual Property

All content on the Platform, including but not limited to the FYNCA name, logo, text, graphics, and software, is the property of FYNCA and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this Platform without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted by Singapore law, FYNCA shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or reliance on any information provided herein. Our total liability to you for any claim shall not exceed SGD 100.

10. Third-Party Lenders

FYNCA is not a party to any loan agreement between you and a lending partner. Any disputes arising from a loan must be resolved directly with the relevant lender. FYNCA does not accept responsibility for the conduct, terms, or actions of any lending partner.

11. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference.

12. Amendments

FYNCA reserves the right to amend these Terms of Use at any time. Updated terms will be posted on this page with a revised effective date. Your continued use of the Platform after any amendments constitutes your acceptance of the updated terms.

13. Governing Law & Dispute Resolution

These Terms of Use are governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes arising out of or in connection with these terms shall be submitted to the exclusive jurisdiction of the Singapore courts.
